GAY MARRIAGE IS ILLEGAL

Since unconstitutional laws are not laws that americans have to follow then gay marriage is still illegal

-Constitution doesn't mention gay marriage
-Bill of Rights says that the states vote on issues not mentioned in the constitution
-Many states voted against in but the federal governement mandated it because 5 unelected officials took away the rights of 300 million+ americans
-Ted Cruz is gonna get elected easily and the republicans will have complete control and be flllibuster proof so ted cruz will repeal it and let the states decide by started all over again.

peterya because we live in democracy and 5 unelected officials can't decide the laws for everyone of us without the states voting. The facts are simple that they didn't have the constitutional authority to authorize fag marriage

1) the supreme court most certainly does have the authority; SUPREME COURT
2) seen as no one voted, should any executive order ever enacted be revoked?
3) if you hadn't noticed, "the people" don't vote on hundreds, if not thousands of bills. That's why we have a HOR, Senate, and Supreme Court

peterya arlo The supreme court is only alowed to define the constitution, and the constitution does not mention gay marriage at all so they have nothing to define. The laws of this country were created to prevent a monarchy and not let only a few people have complete control.

And to answer your second point yes i think that all executive orders are all unconstitutional and they will only last 1 full term as president at most because the next president will repeal it.

you don't live in a democracy johnrocker you live in a democratic republic where everyone has guaranteed rights protected under the law, and the majority can't decide to vote away the rights of a minority because that is called tyranny of the majority and it is actually forbidden in the US so

etienne states have the right to vote if on issues if it not mentioned in the constitution. Regardless of what you think of Fag Marriage the Supreme Court can't redefine marriage in 31 states that voted on it at the ballot box. So basically if people want it to be legal they have to do it at the state level not the federal level since the constitution is federal law and it does not mention gay marriage

Nice to meet you John.  I sense you're leaning republican a little bit (hey, I dig that!  Named myself after a republican president in this website).  I am not going to address my own personal beliefs about gay marriage, but... doesn't the federal government have the right to legislate?  You can criticize the courts (federal and state) but the legislators in the individual states who have voted for it sort of dictated what the law of the land will be.  I get the judicial point, and I think that many democrats are unfair by simply deciding that the court has the right to legislate simply because they're in favor of the law proposed.  When the court is stealing authorities from congress in order to push a right wing policy it's okay.  But when the executive under Reagan steals authorities from congress because of the Iran-Contras thing... well, now stealing is great!

Grant The Government can legislate but they have to do in the guidelines of the constitution and must follow the correct system in the bill of right. The constitution and Admendments apply for all states but issues that were not mentioned in the Constitution must be decided at a state level. The deffinition of marriage has always been a covenant between man & a woman. 31 States voted to keep this deffinition. The supreme court did not have the constitutional authority to have 5 people take away the rights of a majority of the country.

P.S zorbo678 The Supreme Courts is supposed to interpret the written words of the constitution. They are appointed by the president so When Ted Cruz is elected he will appoint strict constitutionalist who value state rights

Okay, John, I concede you may be right.  I'm not a constitutional scholar.  It seems a bit weird to me because I know that the US sees itself as a federation and not a confederation. 
But what would you say, John, about the states that legislate it?  it is legal in those states, is it not?  And what happens then?  Adam and Steve drive on the I 95 and then they're married and not married based on the states they go through?  You know that the moment one state legislates it, the rest of the states would be pushed to treat the marriage as such.  In Israel, for example, the religious courts have some disturbing rules when it comes to marriage, so there are many couples who go to Greece or Cyprus for the weekend, get married at city hall, and go back to Israel.  And Israel recognizes the marriage as legal, whether it conflicts with religious laws or not.  So if I get married to Steve in California and move to Texas, why shouldn't Texas recognize my marriage? 
That being said... I wonder what happens if I marry Steve in California and move to Israel :)

Grant1822 yes its states rights. If you are married in California where it is legal then move to Virginia where it is not then your marriage won't be recognized while you reside in that state.
